The Ministry of Economic Affairs of Taiwan announced the feed-in-tariff for renewable energy projects for 2022

The Ministry of Economic Affairs of the Republic of China (Taiwan) ("MOEA") announced the feed-in-tariff ("FiT") for renewable energy projects for 2022 on January 28, 2022 (Ref. No.: Jing-Neng-Zi No. 11104600440).  
 
We set forth below the key features of the 2022 FiT for solar energy facilities for your reference:
 
1.     For a Type One or Type Two Facility, the FiT applicable at the date on which the applicant receives the Recordation Approval ("RA") ("Date of the RA") applies if the construction of the facilities is completed within 6 months thereafter. For a Type Three facility, the FiT at the Date of the RA applies if the construction of the facilities is completed within 4 months. For instance, for a Type Three Facility, if the RA is received on June 20, 2022 and the construction is completed by October 19, 2022, the Phase 1 FiT will apply.
 
2.     For those solar energy facilities with a capacity of 10MW or more, the FiT applicable at the Date of the RA applies if the construction of the facilities is completed within 24 months thereafter.
 
3.     For those Type One or Type Two Facilities connected to transmission lines with the voltage of 69 kV or above and for which a booster station is installed or which shares a booster station with another facility, the FiT applicable at the Date of the RA applies if the construction of the facilities is completed within 24 months after the issuance of the RA. For those Type Three Facilities connected to transmission lines with the voltage of 69 kV or above and for which a booster station is installed or which shares a booster station with another facility, the FiT applicable at the Date of the RA applies if the construction of the facilities is completed within 12 months thereafter. However, the foregoing does not apply if the construction of the booster station was completed before January 1, 2022.
 
4.     Other incentives for 2022 FiT include:
 
(1)     For the solar energy facilities which are installed in Keelung City, Taipei City, New Taipei City, Taoyuan City, Hsinchu County, Hsinchu City, Miaoli County, Yilan County or Hualien County, a markup of 15% shall be added to the applicable FiT. For the solar energy facilities which are installed in Taitung County, a markup of 8% shall be added to the applicable FiT.
 
(2)     For those solar energy facilities that contribute to the Power Development Assistance Funds, an additional tariff equivalent to the contribution rate stipulated in the Power Development Assistance Funds Contribution Ratio of Power Generation Facilities, Transmission Facilities and Substations shall be granted.
 
(3)     With regard to solar energy facilities for which the module recycling fees are paid according to the Regulations Governing the Installation of Renewable Energy Power Generation Facilities, an additional tariff of NT$0.0656/kWh shall be granted. 
 
(4)     For those solar energy facilities which connect to ultra-high voltage grid and install an ultra-high voltage booster station or share an ultra-high voltage booster station with another facility, a markup as set out in Schedule 5 of the captioned announcement (i.e., the fee scale below) will apply to the FiT.

(5)   For those solar energy facilities using high efficiency modules (i.e., solar PV modules that have obtained certificates of "Voluntary Product Certification on Crystalline Silicon Modules/Thin Film Modules of the Solar PV System" issued by the Bureau of Standards, Metrology and Inspection under the MOEA), a markup as set out in Schedule 4 of the captioned announcement (i.e., the fee scale below) will apply to the FiT.

(6)   For those solar energy facilities that are required to pay the levelized unit costs of grid enhancement work according to the "Expenses Split and Calculation Principle for the Construction of Grid Enhancement of Renewable Energy", an additional tariff of NT$0.0866/kWh (for transmission level) or NT$0.1356/kWh (for distribution level) is applicable to the FiT.
 
(7)   For those roof-top solar energy facilities that are required to pay the grid connection construction fee according to the "Calculation Principle for the Construction Fees of Grid Connection of Rooftop Solar Power Generation Facilities and Renewable Power Generation Facilities", a markup as set out in Schedule 4 of the captioned announcement (i.e., the fee scale below) will apply to the FiT.

5.     In order to encourage the installation of solar power facilities that involve dual-use of the land, after being recognized by the relevant competent authorities, newly-built roof-top or ground-mounted solar energy facilities on farms or fish ponds shall enjoy a markup of NT$0.1934/kWh; solar energy facilities installed on parking lots of highway service areas shall enjoy a markup of NT$0.2321/kWh; solar energy facilities on school stadiums/gyms shall enjoy a markup of NT$0.3868/kWh and an additional NT$0.1547/kWh will be added if metal corrugated sheets are installed on the stadium/gym. Besides, solar energy facilities installed on fish ponds (including roof-top, ground-mounted and floating facilities) will enjoy a markup of NT$$0.0387/kWh, which is equivalent to its contribution of the Fishery Environment Friendly Reserve.
