The Executive Yuan Publishes Amendment to the List of National Core Key Technologies
The National Science and Technology Council (referred to as "NSTC") established and published the National Core Key Technology Determination Measures on April 26, 2023. In accordance with the aforementioned Measures, the Executive Yuan first published on December 5, 2023, the initial list of 22 items of national core key technologies and their respective competent authorities (referred to as the "List"). Subsequently, considering technological progress and industrial development both domestically and internationally, the amended List, totaling 32 items, was published and took effect on December 31, 2024. The newly added 10 items of core key technologies include small satellites, chip circuit design and processes, and battery technology, corresponding to items 15 to 18 and 21 to 26. The numbering order of the items in the List was also adjusted.
The rapid development of AI has garnered global attention in recent years, and this amendment also includes AI high-performance computing technology in the List (Item No. 24). NSTC Chairperson Wu Cheng-wen has stated that the direction of amendments to the List will align with the views of friendly countries, such as the United States and Germany, and integrate with advanced nations.

Attention should be paid to the fact that for national core key technologies, if an act of infringement or a violation constitutes the crime of economic espionage, the violator may be sentenced to imprisonment for a term of 5 to 12 years and may also be fined between NT$5 million and NT$100 million (see Paragraph 1, Article 8 of the National Security Act). If the act involves extraterritorial use, the violator may be sentenced to imprisonment for a term of 3 to 10 years and may also be fined between NT$5 million and NT$50 million (see Paragraph 2, Article 8 of the National Security Act). When imposing fines, if the benefits obtained by the violator exceed the maximum fine amount, the fine may be increased to a range of 2 to 10 times the amount of the benefits obtained.
To ensure national security, maintain industrial competitive advantage, and prevent the illegal outflow of important technologies abroad, which could harm national and industrial interests, enterprises can further strengthen their protection and management mechanisms for trade secrets involving national core key technologies. Individuals who have access to national core key technologies should pay particular attention to relevant regulations and the List, exercise greater caution in performing their duties, and avoid severe criminal liabilities due to violations of the National Security Act and other related regulations.
